Medidas urgentes para responder al impacto económico del COVID-19 y por la declaración del estado de alarma:
- Además de la suspensión de apertura al público de los locales y establecimientos comerciales, las principales medidas en el ámbito laboral aprobadas por el Real Decreto 6/2020, el Real Decreto-Ley 7/2020, por el que se adoptan medidas urgentes para responder al impacto económico del COVID-19, y por el Real Decreto 463/2020, por el que se declara el estado de alarma son:
1.- Consideración excepcional como accidente de trabajo en caso de aislamiento o contagio como consecuencia del virus COVID-19.
Se considerarán, con carácter excepcional, situación asimilada a accidente de trabajo, exclusivamente para la prestación económica de incapacidad temporal del sistema de Seguridad Social, aquellos periodos de aislamiento o contagio de las personas trabajadoras provocado por el virus COVID-19.
Podrá causar derecho a esta prestación la persona trabajadora por cuenta propia o ajena que se encuentre en la fecha del hecho causante en situación de alta en cualquiera de los regímenes de Seguridad Social.
La duración de esta prestación excepcional vendrá determinada por el parte de baja por aislamiento y la correspondiente alta y la fecha del hecho causante será la fecha en la que se acuerde el aislamiento o enfermedad del trabajador, sin perjuicio de que el parte de baja se expida con posterioridad a esa fecha.
2.- Ampliación bonificación para contratos fijos discontinuos:
Las empresas del sector de turismo, así como de comercio y hostelería siempre que se encuentren vinculadas a dicho sector del turismo, que generen actividad productiva en los meses de febrero, marzo, abril, mayo, junio y que inicien o mantengan en alta durante dichos meses la ocupación de los trabajadores con contratos de carácter fijos discontinuo, podrán aplicar una bonificación en dichos meses del 50% de las cuotas empresariales a la Seguridad Social por contingencias comunes, así como por los conceptos de recaudación conjunta de Desempleo, FOGASA y Formación Profesional de dichos trabajadores.
Esta medida será de aplicación desde el 1 de enero de 2020 hasta el día 31 de diciembre de 2020.
- Asimismo, el Gobierno ha anunciado que próximamente aprobará medidas relativas a la agilización de las regulaciones de empleo temporales, así como ayudas a empresas, autónomos y familias.
- Ante la excepcional situación existente, y sin perjuicio de las medidas específicas que se puedan aprobar en los próximos días, desde el punto de vista laboral, a día de hoy, las empresas pueden, dependiendo de los casos, articular una serie de medidas, entre otras:
- Expedientes de regulación temporal de empleo (ERTE) por causa de fuerza mayor.
- ERTE por causas económicas, técnicas, organizativas y/o de producción.
- Excedencia para cuidado de hijos menores.
- Teletrabajo.
- Bolsas de horas, flexibilidad horaria, adaptaciones y reducciones de jornada.
- Licencias retribuidas y no retribuidas.
- Disfrute de vacaciones de común acuerdo entre empresa y trabajador.
- En sectores que están sufriendo un incremento de actividad, aplicación de primas o incentivos, así como aplicación de medidas de distribución irregular de la jornada que permitan atender el incremento temporal de actividad.
- Lo anterior sin perjuicio de cualquier otra alternativa que pudiera venir referida o regulada en el convenio colectivo de aplicación.
En estos momentos difíciles, el Departamento Laboral de TAGSE está a su disposición para ayudarle a definir y poner en marcha las medidas que mejor se puedan adaptar a cada una de sus necesidades particulares.
