En pocos años, los patinetes eléctricos han formado parte en la vida de las ciudades y en nuestro entorno, en el año 2020 se cerró con más de un centenar de accidentes con víctimas en los que estuvieron implicados patinetes eléctricos con resultado de fallecimientos y heridos leves y graves por atropello de patinetes.
- No existe una regulación en el Reglamento General de Circulación, se estará a lo que disponga la correspondiente Ordenanza municipal en cada Municipio.
- No es necesaria autorización administrativa para conducir, ni para circular, no es necesario tener un seguro obligatorio de circulación.
- Hay algunas ciudades que si exigen la obligación de contratar un seguro de Responsabilidad Civil de daños a terceros.
- El patinete estará a lo dispuesto en las normas de circulación, de no respetar las mismas serán sancionados.
– No se puede hacer uso del Móvil circulando
– Solo puede circular una persona en el Patinete
– No se puede hacer uso de auriculares circulando
– Tienen que tener visibilidad nocturna suficiente (luces, reflectantes)
– No se puede conducir bajo los efectos de Alcohol o Drogas
– Límite de velocidad 25 km/h
– No se puede circular por aceras, Vías interurbanas, zonas peatonales
- Si un menor de edad es sancionado, o provoca daños, los padres, tutores legales, responderán del pago.
¿Es obligatorio tener un seguro de circulación?
No es obligatoria la suscripción de un seguro, pero se aconseja que es IMPRESCINCIBLE la contratación de un Seguro de Responsabilidad Civil de daños a Terceros, en caso de siniestro de culpa, se responde frente al tercero perjudicado por la cuantía de los daños ocasionados con todo nuestro Patrimonio
¿ Si te atropella un patinete sin seguro, quién paga los daños derivados del accidente ?
En este caso, quien se haría cargo de los daños -materiales y corporales- que se hayan causado con el patinete y de las posibles indemnizaciones sería el causante del accidente, que ejerce de responsable civil, si el causante es mayor d edad, responderá el directamente, y en caso de ser un menor de edad responderá el Padre/Madre/Tutos legal, y como hemos comentado antes, responde con todo su patrimonio.
TIPOLOGÍAS DE LOS PATINETES VMP QUE SE ASEGURAN
- Tipo A Hoverboards y patinetes eléctricos de Hasta 25 Kg y Velocidad Máxima 20 Km/h.
- Tipo B patinetes eléctricos, Hasta 50 Kg y Velocidad Máxima de 30 Km/h.
EJEMPLOS DE ACCIDENTES CON LOS PATINETES
- Atropello a un peatón
- Colisión a un vehículo, a un escaparate etc.
- Que un vehículo atropelle al Patinete y usuario
- Por cortocircuitos, derrames de baterías, o por incendio
- Por la caída de objetos que transportes (como una mochila)
- En caso de que te caigas del patinete mientras circulas y rompas algo
- Cuando circules, roces con el retrovisor u otro elemento del patinete
- Al plegar/desplegar el patinete
¿ QUE GARANTÍAS TIENE UN SEGURO DE PATINETE, QUE CUBRE Y QUE NO CUBRE EL SEGURO ?
- Cubre solo al Patinete y conductor designado en póliza y no a otro (mayor o menor de edad).
- La póliza debe de contratarla siempre una persona mayor de edad y asegurar al conductor menor de edad.
Garantías:
- El pago de los daños materiales y personales a terceros. (hasta 150.000 –300.000 €)
- La defensa y reclamación de daños (Abogado) Porque un vehículo puede atropellar al patinete y será necesario reclamar los daños del conductor del patinete que puede sufrir lesiones extraordinariamente graves y los daños del patín
- Accidentes personales
- Asistencia en carretera
- Daños accidentales
- Robo
Exclusiones:
- No da cobertura a los daños ocasionados por dolo o por infracción o incumplimiento deliberado de las normas legales.
- Daños que se produzcan por el vehículo objeto del seguro cuando el mismo circule por lugares y zonas donde no esté autorizado su uso y circulación por las diferentes normativas u ordenanzas Municipales.
¿CUANTO PUEDE COSTAR EL SEGURO PARA UN PATINETE ELECTRICO?
Con las garantías mínimas de daños a terceros y Defensa y Reclamación de daños, sale aproximadamente entre 35/50 € al año.
Esta cantidad ira subiendo si queremos incluir garantías adicionales (daños del Patín, Robo, accidentes etc)
