En BOP de 30/09/2020 se han establecido una serie de medidas a favor de autónomos, que
resumimos a continuación
Dichas ayudas van dirigidas a:
Supuesto 1: Autónomos que no tenían reducción de ingresos en el 3er trimestre de
2020 en los umbrales establecidos pero que sí tuvieron derecho a la prestación de
cese de actividad y se benefició en alguno de los meses entre marzo 2020 y junio
2020
Supuesto 2: Autónomos que estuviesen percibiendo la prestación por cese de
actividad por reducción de ingresos del 3er trimestre de 2020, con los límites de
facturación que se establecieron en su momento.
REQUISITOS:
• Estar afiliados y en alta en el Régimen Especial de Trabajadores por Cuenta Propia
el 1 de julio de 2020.
• No haber cumplido la edad ordinaria para causar derecho a la pensión contributiva
de jubilación y, si la ha cumplido, no tener acreditado el período de cotización
requerido para ello.
• Estar al corriente en el pago de las cuotas a la Seguridad Social.
• Prever una reducción en la facturación durante el cuarto trimestre del año
2020 de, al menos, el 75% en relación con el mismo periodo del año 2019.
• Prever que no va a obtener, durante el cuarto trimestre de 2020, unos
rendimientos netos superiores a 5.818,75 euros.
• Si tienen trabajadores a su cargo, deberá acreditarse el cumplimiento de todas las
obligaciones laborales y de Seguridad Social para con sus trabajadores.
CUANTÍA:
• Con carácter general, será el 70% de la base reguladora.
• Como excepción, para los autónomos pluriactivos será del 50 por ciento de la base
mínima de cotización correspondiente a la actividad declarada.
• La entidad gestora abonará al trabajador autónomo el importe de las cotizaciones
por contingencias comunes que le hubiera correspondido ingresar a la Tesorería
General de la Seguridad Social.
DURACIÓN DE LA PRESTACIÓN:
• Tendrá una duración máxima de 4 meses, hasta el 31/01/21.
OTRAS CONSIDERACIONES/OBLIGACIONES:
• El reconocimiento será provisional y estará supeditado a su revisión por parte de la
entidad gestora de la prestación.
• Podrá ser compatible con el trabajo por cuenta ajena, si los ingresos netos
procedentes del trabajo por cuenta propia y los ingresos procedentes del trabajo
por cuenta ajena no superan 2,2 veces el salario mínimo interprofesional. En la
determinación de este cómputo, los ingresos procedentes del trabajo por cuenta
ajena no superarán 1,25 veces el importe del salario mínimo interprofesional.
• Durante el periodo en el que se perciba la prestación, el autónomo deberá
permanecer de alta en el régimen correspondiente.
• En caso de no tener cubierto el período mínimo de cotización por cese de
actividad, se puede estudiar solicitar una nueva prestación extraordinaria
• En caso de cierre de la actividad por orden de la autoridad competente se
tramitaría igualmente una nueva prestación extraordinaria
SOLICITUD:
• Las solicitudes presentadas hasta el 14/10/2020 (incluido) tendrán efectos desde el
01/10/2020.
• Las solicitudes presentadas a partir del 15 de octubre en adelante, tomarán efectos
el día siguiente a la presentación de la solicitud.
• Podrá solicitarse, en cualquier momento, durante el periodo comprendido entre la
entrada en vigor de la norma y el 30 de enero de 2021.
En caso de estar cumplir los requisitos póngase en contacto con nosotros lo antes
posible.
