Es una responsabilidad administrativa, objetiva e ilimitada, mediante la cual se le puede exigir la reparación de los daños causados al suelo y aguas tanto superficiales como subterráneas y elementos naturales, y realizar las acciones necesarias para dejarlo en el estado inmediatamente anterior al daño sufrido; y una Responsabilidad Civil por los daños a bienes y personas
la Administración obligará a reparar el 100% del daño causado, la reparación de estos daños tiene elevados costes para el responsable de los mismos, lo que puede conllevar graves quebrantos económicos y poner en peligro el futuro y viabilidad de la empresa.
El origen más habitual de los daños viene por la fuga o rotura accidental de las balsas, depósitos, presas de contención de Purines, de los tanques de almacenamiento, o los derivados de su transporte, o la rotura de depósitos de combustible.
La citada Ley Medioambiental 26/2007 obliga a la constitución de una garantía financiera antes del 10 de octubre de 2021; y para las granjas y aves de corral hasta el 10 de octubre de 2022, sin olvidar que, en caso de producirse el daño, las empresas igualmente deberán de responder y reparar los daños según la citada Ley.
Como solución a los posibles problemas de contaminación y dar respuesta a la obligatoriedad de la constitución de la garantía financiera, pueden contratar una póliza de seguro de responsabilidad ambiental.
